Terms of Service

1. Agreement to Terms
By accessing or using Violet, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
2. Operator and Eligibility
"Violet," "we," "us," and "our" refer to the operator of the Service. If you need our legal entity name or mailing address, contact contact@hiviolet.ai.
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with permission from a parent or legal guardian.
3. Description of Service
Violet is an AI-powered video storyboard and media workflow platform. Features may include prompt-based template generation, reference URL analysis, project editing, clip management, and media rendering/export.
4. Accounts and Security
You sign in using Google OAuth via Firebase Authentication. You agree to provide accurate information and keep your account credentials and devices secure. You are responsible for activity that occurs under your account.
5. User Content and License
You retain ownership of content you submit, upload, or create in the Service ("User Content"). You grant Violet a limited, non-exclusive, worldwide license to host, process, store, reproduce, and display User Content solely as necessary to operate, secure, and improve the Service.
You represent that you have all rights needed to submit User Content and to instruct Violet to process it.
6. AI-Generated Content
The Service may generate content using AI systems, including third-party models. AI output may be inaccurate, incomplete, non-unique, or unsuitable for your use case. You are responsible for reviewing output before use, including legal, factual, and brand-safety review.
7. Reference URLs and Third-Party Content
If you provide a reference URL, Violet may use automated tools to visit and extract visible content from that page. You are responsible for ensuring your use of referenced URLs and third-party content complies with applicable law and contractual restrictions.
We are not responsible for third-party websites, content, or services.
8. Storage and Accessibility of Media
Media files are stored using third-party infrastructure. Some media objects may be accessible to anyone with a direct URL. Do not upload highly sensitive material unless you have validated that the storage/access model meets your requirements.
9. Acceptable Use
You agree not to:
- Use the Service for illegal, fraudulent, or deceptive activity
- Upload or generate content that violates intellectual property, privacy, or other rights
- Attempt to bypass authentication, authorization, or other security controls
- Probe, scan, disrupt, or overload the Service or third-party systems
- Use automated access methods against the Service without our written permission
- Abuse reference URL tooling to harm third-party sites or systems
10. Third-Party Services
The Service depends on third-party providers (for example, cloud infrastructure, authentication, and AI processing). Third-party services are governed by their own terms and policies. We are not responsible for issues caused directly by third-party services, except as required by applicable law.
11. Intellectual Property
The Service, including software, design, and branding, is owned by Violet or its licensors. Except for limited rights granted in these Terms, no license is granted to you in our intellectual property.
12. Feedback
If you provide feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use that feedback without restriction or compensation.
13. Suspension and Termination
We may suspend or terminate access if we reasonably believe you violated these Terms, created security/legal risk, or misused the Service. Where practical, we will provide notice and an opportunity to address the issue.
You may stop using the Service at any time. Sections that by nature should survive termination (for example, ownership, disclaimers, liability limits, dispute terms) will survive.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
15. Limitation of Liability
To the maximum extent permitted by law, Violet will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, or data, arising out of or related to your use of the Service.
To the maximum extent permitted by law, Violet's aggregate liability for claims arising out of or related to the Service is limited to the greater of (a) amounts you paid to Violet for the Service in the 12 months before the event giving rise to liability, or (b) USD $100.
Nothing in these Terms limits liability that cannot be limited by law (for example, liability for fraud, willful misconduct, or gross negligence where prohibited from limitation).
16. Indemnification
You agree to defend, indemnify, and hold harmless Violet and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your misuse of the Service, or your violation of these Terms.
17. Dispute Resolution, Governing Law, and Venue
Before filing a formal claim, you and Violet agree to try to resolve disputes informally by contacting contact@hiviolet.ai.
These Terms are governed by the laws of the jurisdiction where the Violet operator is organized, excluding conflict-of-law rules. Unless otherwise required by applicable law, exclusive jurisdiction and venue for disputes will be in courts located in that jurisdiction, and each party consents to personal jurisdiction in those courts.
18. Billing, Cancellations, and Refunds
Some features of Violet may require a paid subscription or one-time purchase. By purchasing, you authorize us (or our payment processor) to charge the listed price, applicable taxes, and any recurring fees disclosed at checkout.
Subscription Renewals and Cancellation. Subscriptions renew automatically at the end of each billing period unless canceled before renewal. You can cancel at any time from your account settings. Cancellation stops future renewals and does not retroactively cancel charges already processed.
Refund Eligibility. We offer refunds under the following rules:
- First-time subscription purchase: full refund if requested within 14 calendar days of the initial charge
- Renewal charges: full refund if requested within 7 calendar days of the renewal charge
- Annual plans: non-refundable after 14 calendar days from purchase, except where required by law
- One-time purchases: non-refundable once delivered, except where required by law
Non-Refundable Cases. Refunds are not available for:
- Requests submitted after the applicable refund window
- Accounts terminated for violation of these Terms
- Abuse, fraud, chargeback misuse, or repeated refund abuse
- Taxes or third-party fees that are non-refundable to us
How to Request a Refund. Send a request to contact@hiviolet.ai with your account email, date and amount of charge, last 4 digits of payment method (if available), and reason for request. We aim to respond within 5 business days. Approved refunds are returned to the original payment method and may take 5-10 business days to appear, depending on your bank or card issuer.
Chargebacks. Please contact us before filing a chargeback so we can resolve billing issues quickly. Fraudulent or abusive chargebacks may result in account suspension or termination.
Consumer Rights. Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws.
19. Changes to Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice before they take effect. The updated effective date will appear on this page.
